– There is insufficient evidence to charge two former Victorian policemen implicated in the murder of self-described vampire, Shane Chartres-Abbott, the case’s chief investigator has told a court.
Detective Sergeant Steven Cuxson also said in evidence on Wednesday that the investigation was continuing and if sufficient evidence was found, David Waters and Peter Lalor may be charged.
Detective Cuxson told defence barrister James McQuillan, acting for one of two men charged with the murder, that high men were interviewed but not charged.
Mr McQuillan asked: “To date?”
Detective Cuxson replied: “Correct.”
Both police denied involvement.
A triple murderer turned key Crown witness this week implicated both men in the murder of Mr Chartres-Abbott, a prostitute, in 2003 while he was on trial for raping and mutilating a client.
The two men charged with the murder, Evangelos Goussis and a second accused who cannot be named, are contesting the allegation at a committal hearing.
Mr Chartres-Abbott was gunned down in the driveway of his Reservoir home on June 4th, 2003, as he was leaving for the County Court where he was on trial for the rape and mutilation of a woman called Penny.
Crown prosecutor Andrew Tinney, SC, said all the evidence would show Mr Chartres-Abbott died because Penny’s former boyfriend, Mark Perry, was angry about the attack and decided that vengeance was the order of the day.
He alleged that Mr Perry, who vanished in 2007 and for whose capture there is a $1 million reward, approached Goussis’ co-accused, who then met the witness.
Mr Tinney described how the witness spoke to Mr Waters about finding Mr Chartres-Abbott’s address and how later they met Mr Lalor, who gave the witness the address.
Detective Senior Sergeant Ron Iddles said he had visited the witness in custody since 2007 during Operation Briars, established to investigate possible police involvement in the murder. He told Mr Saunders the witness first expressed concern about implicating Mr Waters, Mr Lalor and a third man, Robert “Bluey Bob” Mather.
